Privacy Policy
gouda-games.com (the “Site”) is owned and operated by Grasper Global Inc. (brand name “Gouda Games”) and its subsidiaries and affiliates. Any reference to “we”, “us”, or “our” means Gouda Games.
Please read this Privacy Policy carefully, as it may have changed since your last visit. Any changes will be posted here. Continued use of the Site indicates your acceptance of this Privacy Policy, including any changes posted to the Site.
This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website. The Site is an informational website only. We do not sell products directly from this Site; instead, we redirect visitors to third-party retail platforms such as Amazon.
Scope of This Policy — Mixed Audience Website
Gouda Games products are designed for families, including children, teens, and adults. Accordingly, the Site is considered a “mixed audience website or online service” as defined under the Children’s Online Privacy Protection Act (COPPA) and its 2025 amendments — meaning it is directed to a general audience but is accessible to children under the age of 13.
As a mixed audience site, we apply the following practices before determining a visitor’s age:
• We may collect only the minimum personal information necessary — and only for the limited purposes of providing parental notice, responding directly to a specific request from the child, or protecting the safety of a child.
• We do not use, share, or disclose any personal information collected prior to age verification for any other purpose.
• We use neutral age-screening mechanisms that do not default to any particular age and do not incentivize users 13 or older with additional benefits or a better experience.
Once age is determined, users under 13 are subject to the specific children’s privacy protections described in the “Children’s Privacy (COPPA Compliance)” section below.
Children’s Privacy (COPPA Compliance — Updated for 2025 Amendments)
We take children’s online privacy extremely seriously. The following provisions apply to the collection, use, and disclosure of personal information from children under the age of 13 and are designed to comply with the Children’s Online Privacy Protection Act (COPPA) and the FTC’s 2025 COPPA Rule amendments (effective June 23, 2025; compliance deadline April 22, 2026).
What We Do Not Collect from Children
We do not knowingly or intentionally collect personal information from any child under the age of 13 beyond what is strictly necessary to: (a) provide parental notice; (b) respond directly to a one-time specific request from a child; or (c) protect a child’s safety. We do not collect biometric identifiers, government-issued identifiers, persistent identifiers for behavioural advertising, or any other personal information from children for commercial purposes.
Parental Notice and Verifiable Parental Consent
Before collecting, using, or disclosing any personal information from a child under 13 beyond the limited purposes described above, we will:
• Provide a direct notice to the child’s parent or guardian describing: what information we intend to collect; how it will be used; whether it will be disclosed to third parties; the specific identities or categories of those third parties; and the purposes for any such disclosure.
• Obtain verifiable parental consent (VPC) prior to any such collection, use, or disclosure. Approved methods of VPC include: a signed consent form submitted by mail, fax, or electronic scan; knowledge-based authentication using dynamic multiple-choice questions; credit card or other payment method verification (used solely for identity verification); video conferencing with trained personnel; government-issued ID verification with immediate deletion after verification; email-plus method (email followed by confirmatory email, letter, or phone call); or text-plus method (text message consent followed by a confirmatory text, letter, or phone call).
• Obtain separate, explicit verifiable parental consent before disclosing a child’s personal information to any third parties for purposes that are not integral to the core service, including disclosures for advertising, marketing, or AI development purposes.
• Notify parents that they may consent to our collection and internal use of their child’s information without consenting to third-party disclosure.
Parental Rights
Parents and legal guardians have the following rights with respect to their child’s personal information:
• Right to Review: The right to review the personal information we have collected from their child.
• Right to Delete: The right to request deletion of their child’s personal information from our records.
• Right to Withdraw Consent: The right to revoke previously given parental consent and to refuse further collection or use of their child’s information.
• Right to Restrict Third-Party Disclosure: The right to consent to our internal use of their child’s information while refusing disclosure to third parties.
To exercise any of these rights, parents may contact us at info@gouda-games.com We will not condition a child’s participation in any activity on the Site on the disclosure of more personal information than is reasonably necessary.
No Targeted Advertising to Children
We do not use, share, or disclose personal information collected from children under 13 for the purposes of targeted advertising, behavioural advertising, or profiling. We do not share children’s persistent identifiers (such as cookies, device IDs, or IP addresses) with third-party ad networks for advertising purposes.
Data Retention — Children’s Information
In compliance with the 2025 COPPA amendments, we retain personal information collected from children under 13 only for as long as is reasonably necessary to fulfil the specific, documented purpose for which it was collected. Indefinite retention of children’s personal information is strictly prohibited. We maintain a written data retention policy that specifies the legitimate purpose and maximum retention period for each category of children’s personal information collected. Upon fulfilment of that purpose, such information is securely deleted or anonymised.
Information Security for Children’s Data
We maintain a written information security programme specifically addressing the protection of children’s personal information, proportionate to the nature and sensitivity of the data collected. This programme includes: designation of a security coordinator; annual risk assessments; regular testing and monitoring of security controls; and oversight of third-party service providers to ensure they maintain appropriate security measures.
Reporting Concerns
If you are a parent or guardian and believe that a child under 13 has provided us with personal information without your consent, or if you believe your child’s privacy rights have been violated, please contact us immediately at info@gouda-games.com We will promptly investigate and delete any such information.
